DESCRIPTION

This is a County-initiated request amending Chapter 5, Chapter 6, Chapter 7, Chapter 8, and Chapter 10, to add the Nutrient Restoration Plan Overlay, restrictions on septic tanks, and definitions; providing for severability; and providing for an effective date. This case is related to LDCPAL-2023-13.

 

Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan. Amendments to the LDC require two public hearings before the Board to be adopted. State law requires one Planning Commission hearing, which was held on March 6, 2024, with a recommendation for approval (Vote 5:1).
