Approve Encroachment Agreements with Tampa Electric Company for the Southeast Wellfield Transmission Main Project (Action)

DESCRIPTION
Three (3) Facility Encroachment Agreements, together with three (3) corresponding Compensation Agreements, with Tampa Electric Company (“TEC”) are needed to use portions of the TEC Corridor (the electric transmission and distribution easement corridor owned or controlled by TEC) for the construction, operation and maintenance of the Southeast Wellfield Transmission Main (“SETM”). The SETM, constructed under Construction Package No. 5, crosses the TEC Corridor at three locations in the vicinity of Bartow Airport (refer to Exhibit “A”) (PRWC Parcels 9010, 9019 and 9021).
Each Encroachment Agreement grants PRWC's consent to maintain, operate and use a 20-inch underground water transmission pipeline, together with any associated permanent and temporary construction easements and temporary access rights, within the TEC Corridor. The provisions of each Agreement, and the benefits thereof, run with the land and remain in effect for the duration of PRWC's use, operation and maintenance of the Pipeline within the TEC Corridor. Each Compensation Agreement sets out the amounts payable to TEC, in consideration for the corresponding Encroachment Agreement, for use of the TEC Corridor and for TEC's attorney's fees incurred in connection with that Encroachment Agreement, as follows:
Parcel 9010: $2,500.00 (use of TEC Corridor) + $2,115.00 (attorney's fees) = $4,615.00
Parcel 9019: $0.00 (use of TEC Corridor) + $4,815.00 (attorney's fees) = $4,815.00
Parcel 9021: $2,500.00 (use of TEC Corridor) + $1,890.00 (attorney's fees) = $4,390.00
Total compensation due to TEC under the three Compensation Agreements: $13,820.00
