Approve First Amendment to Conservation Easement between Polk County and the City of Winter Haven in conjunction with a conservation area known as the Astute Financial Land Trust Property. (No fiscal impact)

DESCRIPTION
In November of 2025 the County entered into an Interlocal Agreement with the City of Winter Haven (“City”) wherein the County provided a funding contribution, in the form of a reimbursement, towards the City’s purchase of approximately 153-acres of property located near the intersection of US Highway 17 and US Highway 92 in the northern part of Winter Haven. As part of the Agreement the City granted a Conservation Easement in favor of the County over the property which was subsequently recorded in O.R. Book 13801, at Pages 1185 through 1274, Public Records of Polk County, Florida. The City Attorney recently contacted the County regarding a scrivener’s error that was discovered in the legal description attached to the Conservation Easement. A corrected legal description has been obtained, and the City has prepared and presented a First Amendment to Conservation Easement to amend the legal description associated with the easement with all other terms and conditions remaining the same. The City has approved the First Amendment of Conservation Easement at its meeting held March 24, 2026. Approving the First Amendment to Conservation Easement will allow the document to be recorded which will correct the legal description associated with the Conservation Easement.
RECOMMENDATION
Request Board approve the aforementioned First Amendment to Conservation Easement.
