DESCRIPTION
The County has received a petition from Jim Schultz to vacate a portion of platted, unopened, and unmaintained right-of-way shown on the plat of Bevington Manor, as recorded in Plat Book 20, Page 47, Public Records of Polk County, Florida. The subject right-of-way lies in Section 03, Township 28 South, Range 24 East.
The plat of Bevington Manor, filed in 1926, dedicated various rights-of-way throughout the plat to the public. The petitioner recently purchased Lots 119 and 120 and subsequently discovered that the existing residence is partially located within the right-of-way shown as Roosevelt Street on the plat which is creating an encroachment. The petitioner is requesting the vacation to eliminate the encroachment which was created by a previous owner. Vacating the subject right-of-way will remove the public's interest in the subject area and clear any clouds on the title to the petitioner's property caused by the encroachment. The owners of the properties located to the east and south of the petitioner's property have responded with an objection to the vacation. However, access is still available to their properties from the remaining portion of Roosevelt Street not included in the vacation request along with other public rights-of-way from the Bevington Manor plat.
The City of Lakeland Electric and Water/Wastewater, Frontier Communications, MCI and Zayo were contacted and no objections were received.
The Office of Planning and Development, Polk County Utilities, and the Roads and Drainage Division have no objections to the proposed vacation.
