DESCRIPTION

The County received a petition from Gumberto Carrazales Torres to vacate the platted 65-foot wide public drainage-retention easement lying along the north side of Lot 1, as shown on the plat of Pineview Estates Phase II, recorded in Plat Book 93, Page 14, Public Records of Polk County, Florida.  The subject easement is located in Section 33, Township 29 South, Range 23 East.

The Plat of Pineview Estates Phase II, filed in 1992, dedicated all rights-of-way and easements shown thereon to the use of the public. The petitioner is the owner of Lot 1 and requested the vacation of the 65-foot wide drainage easement in conjunction with, and to accommodate, plans to construct a pole barn on the property. After a review of the requested vacation the County’s Roads and Drainage Division staff and the County Engineer stated that the north 25-feet of the easement was needed to accommodate existing draining facilities; however, they had no objections to vacating the south 40-feet of the easement.  The petitioner reviewed and agreed to the vacation of the south 40-feet of the easement.  Vacating the south 40-feet of the of the platted drainage-retention easement will remove the public’s interest in the subject area and allow the petitioner to move forward with his planned construction.

RECOMMENDATION

Request Board adopt a resolution to vacate a portion of a platted public drainage-retention easement as shown on the Pineview Estates Phase II, as fully described in the legal description contained in the resolution attached hereto.
