DESCRIPTION
This is an applicant-initiated request for an LDC text amendment to Section 401.06.E.3.i.ii.(1) to increases allowable area for Gas Stations from 20% to 30%, with allowances for higher percentage with a Conditional Use Planned Development, (2) to amend direct frontage to internal road network to signalized intersection of a principal arterial road and, (3) amend Section 401.06.E.3.r.i. to remove Professional Institutional-X (PIX) from Retail standards and (4) add a limitation for Retail in the PIX of 30% without a Planned Development. State law requires one Planning Commission hearing, which will be held on September 10, 2025, with a recommendation for approval by a 7:0 vote.
Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan. Amendments to the LDC require two public hearings before the Board to be adopted.
RECOMMENDATION
Request Board set for the first reading on November 4, 2025, at 9:15 a.m., and the adoption hearing date on February 17, 2026, at 9:15 a.m.
