Authorize Fence Easement to Ashwood West Homeowners Association, Inc. in conjunction with the West Pipkin Road Improvement Project. (No Fiscal Impact)

DESCRIPTION
The County has a project to improve West Pipkin Road to a four-lane corridor from Medulla Road to Harden Boulevard which is substantially completed. The County purchased multiple platted lots and a tract shown on the plat of Ashwood East, located along the south side of W. Pipkin Road for mainline right-of-way and a storm water facility associated with the project. At the time they were acquired the lots and tract were encumbered with various private easements dedicated to the Ashwood West Homeowner’s Association (“Ashwood”). One of the easements was a 5-foot wide wall easement which contained a decorative fence with columns which needed to be relocated to accommodate the project. The County entered into a Right-of-Way Agreement with Ashwood regarding the easements and the fencing prior to the start of the project. Per the terms of the agreement Ashwood executed a Partial Release of Easements for all of the private easements located within the right-of-way parcels and the County agreed to relocate the fencing along the W. Pipkin Road frontage with like-kind decorative fencing. Additionally, the County agreed to grant a fence easement to Ashwood over the relocated decorative fence once completed which is to be maintained by Ashwood. The construction of the relocated decorative fence has been completed and a legal description for a 5-foot wide easement (2.5-feet each side) has been prepared. Authorizing a Fence Easement to Ashwood will give the HOA the easement needed to maintain the decorative fence and fulfill the terms of the agreement related to the easement.
RECOMMENDATION
Request Board authorize the aforementioned Fence Easement.
