DESCRIPTION
The County has received a petition from Redstone Properties, LLC, as authorized agent for S.A.W. Properties, LLC, and JR Holding Group, LLC, to vacate and close a portion of maintained right-of-way for Second Terrace a/k/a 1st Street North. The subject right-of-way lies in Section 05, Township 29 South, Range 26 East.
The right-of-way for Second Terrace, as shown on the maintained right-of-way map recorded in Map Book 10, at Pages 8 and 9, Public Records of Polk County, Florida, runs northwest off of 2nd Street North for approximately 400-feet, turns to the southwest and then runs for approximately 140-feet more. The petitioner is requesting a vacation of the portion running southwest, which is identified as 1st Street North on some maps. The petitioner owns the property surrounding the subject area and is requesting the vacation in order to remove the bifurcation of the right-of-way in conjunction with pending development plans. Due to the fact that the subject area only serves the petitioners' property the vacation will not negatively impact local traffic on the roadway. Vacating the requested area will remove the public's interest, allow the County to cease any maintenance activities associated with this portion of the roadway and allow the petitioner to assemble it with their properties and move forward with their development plans.
The City of Winter Haven Sewer/Water and Fiber, Florida Public Utilities, Frontier Communications, MCI, Summit Broadband, Tampa Electric Company (TECO), and Uniti Fiber LLC were contacted and no objections were received.
The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.
