Approve Agreement for Transfer of Public Road between the City of Winter Haven and Polk County for a portion of Waters Road and authorize County Deed for the right-of-way associated therewith. (No fiscal impact)

DESCRIPTION
Waters Road is a county-maintained roadway running from Old Bartow Lake Wales Road southward approximately one-half of a mile to a dead-end. The road is classified as a local residential roadway and lies within and/or adjacent to the municipal limits of the City of Winter Haven (“City”). A portion of Waters Road from Old Bartow Lake Wales Road southerly approximately 1,060-feet is proposed to be transferred to the City in conjunction with proposed development adjacent to the roadway.
Florida Statutes allow for the transfer of public roads between jurisdictions by mutual agreement of the affected governments and a conveyance of the associated right-of-way by deed. The City has reviewed and approved, at its meeting held November 12, 2024, an Agreement for Transfer of Public Road for the transfer of the portion of subject portion of the roadway and has agreed to accept the County Deed for the associated right-of-way. Approving said Agreement and authorizing the County Deed to the City for the associated right-of-way will transfer ownership of the subject road portion and will remove that portion of the roadway from the County’s Road inventory thereby allowing the County to cease maintenance and future liability responsibilities associated with it.
RECOMMENDATION
Request Board approve the aforementioned Agreement for Transfer of Public Road and authorize the County Deed to the City for the right-of-way associated therewith.
