DESCRIPTION

The County was contacted by the owner of property located at the southwest corner of the intersection of Midway Road and East Way Road in the Poinciana area regarding the roadway in relationship to its property.  A recent survey performed for the owner showed that the northeast corner of the owner’s property extended into the roadway.  Research revealed that this property is not platted and is part of an unrecorded subdivision known as Lake Marion Terrace - 2nd Addition.  The drawings associated with the unrecorded subdivision depict what appear to be rights-of-way for the roadways; however, it does not appear that these rights-of-way were ever conveyed or otherwise dedicated to the County or public.  Midway Road and Eastway Road are both public roadways which have been maintained by the County in excess of thirty years.  In order to clear any clouds on the owner’s title caused by the roadway encroachment shown on the survey the County requested the owner convey any interest it has in a corner clip at the corner of its property.  Additionally, the County requested the owner convey any interest it may have in that portion of right-of-way for the roadway lying adjacent to its property to approximately the center of the roadway.  The owner, BKN.Brickman Corp, has agreed to the County’s request and has executed and delivered a Quit Claim Deed for the right-of-way.  Accepting the Quit Claim Deed will give the County documented right-of-way for, and clear any potential encroachments caused by, the County roadways adjacent to the owner’s property.

RECOMMENDATION

Request Board accept the aforementioned Quit Claim Deed.
