DESCRIPTION
The County has received a petition from Robert and Elba Wimbley, to vacate a portion of platted, unopened, and unmaintained right-of-way shown as "Business Circle" lying adjacent to Lots 109 through 113, as shown on the map of W.J. Howey Land Company Plat Book 3, Pages 50 and 51 and on the map of Starr Lake Florida, Plat Book 4, Pages 7 and 8, Public Records of Polk County, Florida. All lying in Section 15, Township 29 South, Range 27 East.
The maps of W.J. Howey Land Company and Starr Lake Florida filed in 1914 and 1915, respectively, depict various rights-of-way throughout which are presumed to be public. The petitioners own the property adjacent to the south and east of the aforementioned portion of the "Business Circle" and have requested the vacation in order to more fully utilize the properties for a planned residence. During a review of the area, it was discovered that portions of the right-of-way adjacent to Lots 108 and 113 are shown on the tax maps as having been previously vacated; however, no evidence of a prior vacation could be located. The County is adding the remaining portion of the "Business Circle" right-of-way lying south of Starr Avenue, which lies adjacent to Lots 108 and 113, to the vacation request to clear any potential clouds on the title of the adjacent parcels. County staff contacted the adjacent property owner and received no objection. Vacating the right-of-way will remove the public's interest in the subject area and allow the petitioners, and adjacent property owner, to more fully utilize their properties for planned residence.
