DESCRIPTION

In July of 1968 Carl W. May and Jean N. May, his wife granted to the County a Drainage Ditch Easement which was recorded in O.R. Book 1171, at Page 1006, Public Records of Polk County, Florida. The document contains multiple easement descriptions which are part of a larger drainage system maintained by the County in and around May Manor Mobile Home Park in the Lakeland area which ultimately outfalls to Lake Bonnet.  Through discussions with the City of Lakeland (“City”) it has agreed to take over maintenance responsibilities, in conjunction with its drainage needs, for a portion of the drainage system running generally south off of Grady Road and along the west boundary of May Manor.  A Partial Assignment of Easement has been prepared which would assign the County’s interest in the agreed upon portion of the easement to the City.  Approving the Partial Assignment of Easement will allow the City to utilize the area in conjunction with its drainage needs and allow the County to cease maintenance responsibilities for the subject portion of the drainage system.

RECOMMENDATION

Request Board approve the aforementioned Partial Assignment of Easement.
