DESCRIPTION
The County has a Community Investment Project to improve Power Line Road to a four-lane corridor from South Boulevard to Hinson Avenue known as Power Line Road Phase 2. To allow for construction of the roadway, the County will need to acquire additional right-of-way from impacted property owners. The alignment phase of the project was recently completed, which includes proposed storm retention pond alternatives, and full engineering design for the roadway is forthcoming. The County was contacted by the owner of Parcel ID Number 272710-7300000-012500, Connie Miller, regarding the purchase of her property for the project. The parcel is a rectangular shaped parcel containing approximately 4.5-acres located at the northwest corner of Power Line Road and Neal Road which is improved with a single-family residence. The recommended alignment, as approved by the Board, indicates that the property will likely be impacted by the project in its entirety for mainline right-of-way and a storm water retention facility. Although the project is unfunded for construction and full right-of-way acquisition acquiring certain properties when opportunities become available provides a benefit to the County. The County hired an independent appraiser to establish a value for the property and the owner rejected the County's offer. Subsequent negotiations with the owner, have resulted in a proposed purchase amount of $700,000 for the property. The owner has not incurred any attorney fees or expert costs in conjunction with this acquisition.
The County Attorney's Office and the Real Estate Services Director have reviewed the agreement and recommend approval. The alternative of acquiring this parcel in the future through condemnation litigation would result in substantial cost to the County. Appro...
