DESCRIPTION
Grenelefe Resort Development, LLC (the "Petitioner") has filed a Petition to Establish the Grenelefe Community Development District (the "Petition"), which requires approval by the Board of County Commissioners, along with adoption of a related ordinance establishing the CDD.

If approved, the petitioner has also offered to enter into the proposed Interlocal Agreement with Polk County, making a formal and binding commitment to the BoCC to ensure that certain development pledges made during the public hearings for cases LDCPAL-2024-5, LDCPAL-2024-6, LDCT-2024-10, and LDCDD-2024-6 are kept throughout the life of the development. These pledges include multimodal corridor with entry enhancements, landscape median islands, open space commitment above and beyond the County's requirements, enhanced parks beyond the County's recreation requirements, landscape enhancements, enhanced stormwater systems, roadway design, and buffer walls as indicated on a binding plan attached. This agreement is binding to the CDD which will be a quasi-municipal entity. It cannot be amended without the agreement of both parties (the CDD board and the Board of County Commissioners). This does not bind the County to any action other than the legal enforcement of the agreement.

This agreement is to be signed by a County official and an officer of the Grenelefe CDD; however, the CDD will not be established until the BOCC's approval of the Petition and related ordinance following a public hearing on January 7, 2025. Accordingly, this agreement may only be considered for approval by the BOCC once the Petition is approved and the related ordinance is adopted establishing the CDD.
