DESCRIPTION
In November 2024 the Board adopted a resolution vacating the eastern portion of a County maintained roadway known as Holly Hill Grove Road 1 which was requested in conjunction with a planned big box commercial development. As part of the construction of the development the developer was required to construct a cul-de-sac at the new terminus of Holly Hill Grove Road 1. Additionally, as part of the vacation the owner of the property granted an easement to the County to allow for the full roadway to remain open and operational until such time as the cul-de-sac was completed and the right-of-way associated with it has been conveyed to the County after which it would be released. The improvements associated with the cul-de-sac have been completed and the current owner of the property, Wal-Mart Stores East, LP, has executed and delivered a Quit Claim Deed for the right-of-way associated with the improvements. Accepting the Quit Claim Deed will give the County the right-of-way needed for the cul-de-sac improvements and authorizing a Release of Easement will release the encumbrance of the easement which is no longer needed.
RECOMMENDATION
Request Board accept the aforementioned Quit Claim Deed and authorize a Release of Easement.
