DESCRIPTION
The Florida Department of Agriculture and Consumer Services ("Forestry") has utilized property and buildings on a portion of County owned property located along Lincoln Avenue for nearly 30-years under lease agreements. The larger County property is the site of the Dundee Roadway Maintenance Unit and Forestry leases approximately 1-acre in the southeast corner as a storage and staging area for its local forestry service operations. The current lease, identified as Lease Agreement No. 348, is for an initial term of ten years beginning in November 2017 with automatic one-year renewals at the end of the term. The current lease contained only an aerial exhibit depicting the portion of the County owned property subject to the lease and no written legal description for the leases area. Discussions between Forestry and the County regarding the lease area resulted in the preparation of a legal description for specific area currently being utilized by Forestry. Additionally, Forestry expressed an interest in continuing its use of the property and buildings beyond the upcoming expiration date. In an effort to more clearly define the lease area and to memorialize the continued use of the property by Forestry a proposed Amendment to Lease Agreement was prepared which contains a legal description of the area and a revised term. The proposed Agreement revises the term to an initial term of fifteen (15) years commencing on April 7, 2026 and includes an automatic renewal term for and additional fifteen (15) years with all other terms and conditions remaining the same. The Real Estate Services Director and the County Attorney's Office have reviewed the amendment and recommend approval.
