Accept Quit Claim Deed, Sidewalk Easement and Access Easement from BVT-Aventon Holly Hill Owner, LLP in conjunction with proposed development as requested through the Development Review Process. (No fiscal impact)

DESCRIPTION

As a result of a proposed development adjacent to a County roadway known as Holly Hill Grove Road 2, the County, through its Development Review Process has requested additional right-of-way in order to bring the right-of-way lying adjacent to the subject development up to current road classification standards.  Additionally, the County requested an easement for a portion of a public sidewalk being constructed as part of the development which lies outside of the right-of-way for Holly Hill Grove Road 2 as well as an easement over the internal development roadways in order to access county owned wastewater facilities adjacent to the site.  The owner, BVT-Aventon Holly Hill Owner, LLP, has agreed to the county’s request and has execute and delivered a Quit Claim Deed, Sidewalk Easement and Access Easement to the County.  Accepting the following instruments will give the County the right-of-way needed to upgrade the existing right-of-way adjacent to the development to meet current road classification standards as well as provide the easements needed for the sidewalk and utility facilities.

RECOMMENDATION

Request Board accept the afore-mentioned Quit Claim Deed, Sidewalk Easement and Access Easement.
