DESCRIPTION
It was discovered by a title agency in conjunction a previously planned sale and closing of a parcel of land identified as Parcel ID Number 242536-000000-022010 located along the north side Deen Still Road that a Quit Claim Deed recorded in O.R. Book 8535, at Pages 1589 through 1592 conveyed an interest in the above parcel to W.A. Read, Jr The chain of title associated with this conveyance is uncertain; however, the presence of the document has created a cloud on the title. Mr. Read is now deceased and the title agency contacted the attorney for his estate, Drew Crawford, to obtain a release of the estate’s interest in the property. After reviewing the matter Mr. Crawford determined that Polk County is a devisee of, and has a quarter-interest in, the Read Estate by virtue of Mr. Read’s Last Will & Testament and as such would need to be a party to any release. Mr. Crawford contacted the County to bring the matter to its attention and has helped to facilitate the title clearing by the County along with his clients which are the remainder of the Estate. Authorizing a County Deed to James A. Sadler, as Trustee of the Sadler Revocable Trust u/a/d/ February 5, 2018 will release any interest the County may have in the subject property in order to clear the cloud on the title to help facilitate any future sales.
RECOMMENDATION
Request Board authorize the aforementioned County Deed to James A. Sadler, as Trustee of the of the Sadler Revocable Trust u/a/d/ February 5, 2018. Further request Board waive any funds received by the Estate for Polk County’s interest in conjunction with this County Deed.
