The County received a petition from John "Bart" Allen as authorized agent for 1917 Development, LLC, to vacate a portion of deeded and maintained right-of-way for Spring Road, Auburndale, Florida. The subject right-of-way lies in Sections 20 and 29, Township 27 South, Range 25 East.
Spring Road was, until recently, a County maintained roadway running from Braddock Road northward for nearly a mile to a dead end. The right-of-way for Spring Road consists of right-of-way conveyed to the County in 1945 by a deed which was recorded in Deed Book 755, at Pages 311 and 312 along with a maintained right-of-way map recorded in 1973 in Map Book 2, at Pages 273 and 274. Additional right-of-way for the roadway near its intersection with Braddock Road was conveyed to the County by the State of Florida in conjunction with the Polk Parkway (SR570) by a Quit Claim Deed recorded in 2005 in O.R. Book 6512, at Pages 997 through 1029. Spring Road was recently severed in conjunction with improvements to the Polk Parkway which included a new interchange at Braddock Road. The right-of-way bisects portions of the petitioner's property and it requested the vacation of the right-of-way adjacent to its property in order to remove the bifurcation and prepare the property for development or sale. Additionally, it was determined that the maintained right-of-way extended northerly into property owned by the State of Florida, Department of Transportation ("Turnpike") for its SunTrax facility. No evidence could be found that this portion of right-of-way was previously vacated and County staff requested it be included in the vacation to remove any encroachments associate with it.
