Approve Agreement between Tohopekaliga Water Authority and Polk County. (No fiscal impact)

DESCRIPTION
Tohopekaliga Water Authority (“TOHO”) has a project to construct a production water well within, and to serve, its service area in the Poinciana area. TOHO has identified a portion of a parcel owned by the County which would accommodate the construction and operation of the proposed well and associated facilities. The parcel is an irregular shaped parcel located at the northwest corner of Mackerel Road and Halibut Road. A small County maintained playground, known as Lil Halibut Park, is located at the western end of the parcel. TOHO has requested a 65-foot square parcel at the southeast corner of the county-owned property for its well site along with a 65-foot by 165-foot temporary laydown area adjacent to the well site for use during the construction of its project. County staff reviewed the request and determined that there are no current plans to utilize the requested area; however, the County requested that TOHO secure its well site with fencing or a wall and construct a concrete driveway from Halibut Road which will serve the County’s remainder property all as part of the construction of its project. TOHO has agreed to the County’s requests and has executed an Agreement for the well site, laydown area and construction requirements. Approving the Agreement and authorizing a County Deed to TOHO for the well site parcel will allow TOHO to move forward with its well project.
RECOMMENDATION
Request Board approve the above-mentioned Agreement and authorize a County Deed to TOHO for the well site parcel.
