Approve Partial Release of Easement for a portion of drainage easement in conjunction with an FDOT project on US Highway 98 in the Lakeland area, FDOT Parcel No. 100.  (No fiscal impact)

DESCRIPTION

The State of Florida Department of Transportation (hereinafter “FDOT”) has a project to make improvements to US Highway 98 (SR 35).  To facilitate the improvements the FDOT has identified a right-of-way parcel needed for the project, known as Parcel 100, located at the northwest corner of US Highway 98 and Edgewood Drive East.  This parcel is partially encumbered with a drainage easement in favor of Polk County.  FDOT contacted the County to request a subordination of its interest in that portion of the drainage easement lying within Parcel 100.  After a review of the request, it was determined that the proposed improvements by FDOT render the drainage easement unnecessary as the drainage associated with the easement is being accommodated by the project.  Additional research revealed that the drainage easement, granted in 1990, was associated with improvements to Edgewood Drive which was transferred to the City of Lakeland not long afterwards, but the easement was not formally assigned to the City.  Due to the fact that the drainage easement is no longer needed County staff proposed to release its interest in that portion of easement lying within Parcel 100 in lieu of a subordination of its interest and FDOT has agreed.  The City of Lakeland was contacted and has no objections to the proposed release of the easement.  Approving the Partial Release of Easement will allow the FDOT to fully utilize the right-of-way parcel for the planned improvements.

RECOMMENDATION

Request Board approve the above-mentioned Partial Release of Easement.
