DESCRIPTION
Polk County's Utilities Division completed the construction of the operation's building and regional water plant facility, including multiple wells, on a 74-acre tract of land owned by the County in the Gordonville area north of Bartow Municipal Airport. Tampa Electric Company ("TECO"), as the authorized provider of electric utility service, agreed to provide electric service as needed during the construction of the improvements; however, TECO requested an easement over the entire project property due to the fact that the exact location of the proposed facilities was unknown at the time. The Board previously approved a Temporary Easement over the entire project property to allow for the installation of the electric facilities by TECO during the construction of the project. The Temporary Easement contained a provision that once the construction of the electric facilities was completed a perpetual easement measuring 15-feet wide (7.5-feet each side of said facilities) will be granted by the County and the temporary easement will be released by TECO and/or automatically terminate after the granting of the permanent easement. The construction of the electric facilities for the project is complete and a legal description for a 15-foot wide easement, relative to the facilities as constructed, has been prepared. Based on this TECO has prepared and submitted an Easement for review and approval. Authorizing the Easement will provide TECO with a permanent easement specific to their constructed facilities and will allow for the release of the previously granted temporary easement to reduce the encumbrance on the property.
RECOMMENDATION
Request Board authorize the aforementioned Easement to Tampa Electric Company.
