DESCRIPTION
The County was contacted by property owners adjacent to Galloway Road to the south of its intersection with 10th Street North regarding drainage concerns in the area. After a review of the area it was determined that an existing drainage ditch running westward off of Galloway Road was in need of clearing and re-grading due to overgrowth. Additional research revealed that in 1962 an easement was granted to the State of Florida for two outfall ditches associated with the roadway, one to the north of 10th Street and one to the south, which were transferred to the County along with the roadway in 1983. However, at some point after the easement was established the ditch to the south of 10th Street was realigned slightly to the south and currently does not lie within the easement area, but along the southern boundary of a residential parcel. County staff contacted the owners of the residential property and requested an easement over the existing drainage ditch. The owners, Connie Cristancho and Fabio Castro, as successor trustees, have agreed to the County's request and have executed a Drainage Easement to the County. No evidence could be found that the original easement has ever been released, but it is no longer needed due to the new easement. Accepting the Drainage Easement will give the County the easement needed to allow for maintenance of the existing drainage ditch and authorizing a Partial Release of Easement will remove the encumbrance of original easement, which is not needed, from the owners' property.
RECOMMENDATION
Request Board accept the Drainage Easement from Connie Cristancho and Fabio Castro, successor trustees, and authorize the above-mentioned Partial Release of Easement.
