DESCRIPTION
A large-scale multi-family residential development located to the west of US Highway 27 and to the south of Interstate 4 has a proposed entrance on the south side which derives access from a county-maintained roadway known as Heller Court to the east of the development. The County, through its Development Review Process, requested that the developer construct an extension of the Heller Court roadway for approximately 700-feet westerly to the development entrance. The drainage associated with the roadway improvements is accommodated through a joint use storm water retention pond located along the north side of the development. To accommodate the operation and future maintenance of the roadway extension and associated drainage, additional right-of-way and a drainage easement is needed from the developer, Haven at Davenport, LLC ("Haven"), along with additional right-of-way needed from two other property owners along the extension of Heller Court. Haven has executed and delivered a Quit Claim Deed for its portion of the right-of-way along with a Perpetual Joint Use Drainage Easement for the drainage facilities. Additionally, Haven has coordinated the conveyance of the right-of-way needed from the other two property owners, Alta Davenport, LLC and Heller Highway 27, LLC who have both executed and delivered Quit Claim Deeds to the County for their remaining portion of the needed right-of-way. In addition to the above items the County requested an easement from Haven for a utility master meter assembly in conjunction with the development and Haven has executed and delivered a Polk County Utilities Easement.
