DESCRIPTION
The County has received the following requests to adopt resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming any rights of the County or the public in certain platted and unmaintained right-of-way along with a portion of maintained right-of-way located within Polk County. Florida Statutes, Section 336.10, requires the Commissioners hold a public hearing to consider Petitions adopting resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming property under their control. Setting a public hearing date will comply with Florida Statutes and allow the request to be considered.
Request Board set a public hearing date for the following requests to vacate platted and unmaintained right-of-way along with a portion of maintained right-of-way. Suggested Hearing Date: Tuesday, November 21, 2023 at 9:30 a.m., or immediately following the regular agenda:
1. Consider a petition by Jeffrey D. Hofius, as authorized agent for Davenport Legacy, LLC, to adopt a resolution vacating platted and unmaintained right-of-way lying adjacent to the east of Block 2 as shown on the map of Captain David Burn's Subdivision, as recorded in Plat Book 4, at Page 34, Public Records of Polk County, Florida. The subject right-of-way lies in Section 12, Township 26 South, Range 27 East.
2. On Board's Motion, consider a request to adopt a resolution vacating a portion of maintained right-of-way now known as Huckleberry Road as shown on the Maintained Right-of-Way of Horse Shoe Creek Road as recorded in Map Book 4, at Pages 303 through...
