Authorize a County Deed to the City of Lakeland to clear the encumbrance of an easement for right-of-way in conjunction with the City’s C.D. McIntosh Power Plant. (No fiscal impact)

DESCRIPTION
The City of Lakeland contacted the County regarding an easement encumbering property owned by the City which is the site of the C.D. McIntosh Power Plant. The easement was granted to the County through a Right-of-Way Deed dated July 1967 which was subsequently recorded in O.R. Book 1098, at Pages 946 through 948. The easement was presumably granted for a planned roadway running west off of Lake Parker Drive; however, no evidence could be located to indicate that it was ever constructed but if so it has not been utilized as a public roadway for over 40 years. The City has plans associated with the plant property and has requested the County execute a County Deed to release any interest it may have that portion of the easement to remove any clouds on the title caused by it. Authorizing a County Deed to the City for the portion of easement located over plant site will release the County’s interest in the area and remove any clouds on the title to the City’s property caused by the easement.
RECOMMENDATION
Request Board authorize the aforementioned County Deed to the City of Lakeland.
