DESCRIPTION
Request the Board, by its own motion, vacate a 5-foot wide platted public drainage easement over Lots 40 and 41 as shown on the plat of Cypress Point, recorded in Plat Book 63, Page 40, Public Records of Polk County, Florida. The subject easement lies in Section 10, Township 29 South, Range 26 East.
The County recently completed a drainage improvement project on Cypress Point East which consisted of the construction of a new drainage pipeline running north from an inlet located within the cul-de-sac to Lake Eloise. The new pipeline replaced a pipeline that was damaged and not functioning properly which ran from the cul-de-sac eastward utilizing a 5-foot wide platted public drainage easement to a canal which connects to the lake. Due to the fact that the platted drainage easement was so narrow and situated in such close proximity to existing residences on both sides it could not be utilized for the replacement pipeline and easements were granted by property owners along the new route to accommodate the improvement project. The platted public drainage easement, which is located over Lots 40 and 41 of the plat, is not suitable for any drainage use by the County based on its size and location and it is requested that the platted public drainage easement be vacated to remove the encumbrance of the easement over the lots. Vacating the platted public drainage easement will remove the encumbrance of the easement and allow the property owners to fully utilize the area in conjunction with their properties.
The County's Roads and Drainage Division staff and the County Engineer have reviewed the request and have no objections to the vacation of the easement.
