DESCRIPTION

This is a County-initiated request for an LDC Text amendment to Chapter 3 Conditional Uses, Section 303, Criteria for Conditional Uses, Individual Mobile Homes, to allow mobile homes by right in subdivision plats recorded prior to May 20, 1971. These plats were approved before the County adopted first land use ordinance restricting the placement of mobile homes. The last approval prior to the ordinance effective date was Plat Book 50, Page 41 Lakeview Park. State law requires one Planning Commission hearing, which was held on April 2, 2025, where the Planning Commission recommended Approval (Vote:6-1).

Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan. Amendments to the LDC require two public hearings before the Board to be adopted. This is the second of the two hearings.
