Approve Subordination of County Utility Interests between the State of Florida Department of Transportation and Polk County, FDOT parcels 803.07 and 804.07.  (No fiscal impact)

DESCRIPTION

The State of Florida Department of Transportation (hereinafter “FDOT”) has stormwater retention facilities associated with, and the south of, US Highway 192 in the Four Corners area of Polk County.  FDOT is working with an adjacent property owner regarding ownership of the stormwater ponds property and is retaining perpetual easements to accommodate its drainage facilities.  Portions of the perpetual easements are encumbered with utility easements in favor of Polk County.  FDOT has requested the County subordinate its interest in those portions of the utility easements lying within the FDOT easement parcels.  Approving the Subordination of County Utility Interests will authorize the Chair to execute the document and allow its recordation, which will allow the FDOT to fully utilize the easements for its facilities.

RECOMMENDATION

Request Board approve the above-mentioned Subordination of County Utility Interests between the FDOT and Polk County.

No fiscal impact.
