DESCRIPTION
Polk County initiated a foreclosure action against Salvador Lopez Sr. ("Respondent") regarding the property located at 5555 E. Hinson Avenue, Haines City, FL, and associated parcels ("Violation Property"). The foreclosure action seeks to collect on outstanding Code Enforcement fines and costs totaling approximately $904,348.02.
The Respondent currently desires to keep the Violation Property and to sell separate, unassociated properties located in Haines City. The Respondent has requested a partial release of the County’s Code Enforcement liens to clear title for that specific sale. Following negotiations, the County Attorney’s Office and Code Enforcement staff have reached a structured settlement that secures a substantial upfront payment while preserving the County's ability to immediately resume foreclosure if future violations occur.
RECOMMENDATION
Approve the Stipulated Settlement Agreement with Salvador Lopez Sr., authorize the Chair to execute the Agreement, and authorize staff to execute the necessary partial release of liens and file a Notice of Settlement in the pending circuit court litigation
FISCAL IMPACT
Approval of this agreement will result in an immediate revenue payment of $300,000.00 to the County. The remaining balance of the outstanding liens will remain fully secured against the Respondent's primary Violation Property.
