Approve First Amendment to Interlocal Agreement with the City of Frostproof for Collection of Polk County Impact Fees (No fiscal impact)

DESCRIPTION
On January 3, 2017, Polk County and the City of Frostproof entered into an interlocal agreement providing, in part, for the City’s collection and remittal of County impact fees (the “Agreement”). Section 5 of the Agreement requires the City to maintain the collected County impact fees separate and distinct from all other revenues and to transfer such collected impact fees to the County no later than the 15th day of each month following collection.
The City has requested to amend the Agreement so that the collected impact fees are due to the County no later than the 30th day of each month following collection, to allow the City more time to comply with their Agreement obligations. County staff and the County Attorney’s Office recommend approval of the request and the First Amendment, which was approved and signed by the City on February 17, 2025.
RECOMMENDATION
Approve the First Amendment to Interlocal Agreement with the City of Frostproof for Collection of Polk County Impact Fees to provide the City with additional time for remitting collected impact fees to the County.
