DESCRIPTION

Over 50 years ago, the County had an agreement with the State for the operation and maintenance of the Lake Gibson Control Structure. After 50 years that agreement expired. The SWFWMD is wanting to enter into another agreement for the operation and maintenance of the Lake Gibson Control Structure.

 

During the original agreement, a portion of N. Socrum Loop Road was transferred to the City of Lakeland. A portion of the Lake Gibson Control Structure is located within the right-of-way for N. Socrum Loop Road in the City of Lakeland. Therefore, the City of Lakeland is part of the temporary License Agreement.

 

Attached is the License Agreement for the Lake Gibson Control Structure. The temporary agreement states that the SWFWMD is responsible for all costs associated with the operation and maintenance of the control structure and that the County, the SWFWMD and the City will work together on any capital improvements to the structure. Once approved, the County, the City and the SWFWMD will need to enter into a permanent agreement for the operation and maintenance of the control structure.

 

RECOMMENDATION

Request Board approve the License Agreement for the Lake Gibson Control Structure between Polk County (County) and the Southwest Florida Water Management District (SWFWMD).
