DESCRIPTION

Ernie Caldwell Properties, LLC (“Ernie Caldwell”) is the developer of a residential subdivision known as Astonia located along Little Zion Road to the west of CR 547 and to the south of Ernie Caldwell Boulevard.  The County, through its Development Review Process, requested improvements to Little Zion Road from CR 547 to, and adjacent to, the development.  The improvements have been completed and the County requested additional right-of-way to accommodate the improvements and to bring the rights-of-way up to current County road classification standards.  Additional right-of-way parcels were identified along the north side of Little Zion Road and along a portion of the south side of the roadway near its intersection with CR 547 which are owned by Ernie Caldwell and Astonia Community Development District (“CDD”).  The right-of-way along the south side of a portion of Little Zion Road had not previously been identified; however, Ernie Caldwell requested to convey the entirety of a low lying tract of land adjacent to the roadway which includes the needed right-of-way.  The CDD and Ernie Caldwell have executed and delivered Quit Claim Deeds to the County for the additional right-of-way and the adjacent tract.  Accepting the Quit Claim Deed will give the County the right-of-way needed to upgrade the existing rights-of-way for Little Zion Road to meet current road classification standards.

RECOMMENDATION

Request Board accept the aforementioned Quit Claim Deeds.
