DESCRIPTION
In March 2023 multiple related entities, Jackstone Development, LLC; GLK Real Estate LLC; CH-DEV LLC; JMBI Real Estate LLC and Northeast Polk Land Investments LLC (collectively, the "Developer") entered into an Infrastructure and Impact Fee Credit Agreement with Polk County regarding improvements to, and extension of, a transportation facility known as Power Line Road from US Highway 17/92 to South Boulevard. As part of the Agreement the Developer agreed to convey the right-of-way needed for the corridor in two parts and at two different times. The first part identified as Portion "A" in the Agreement, from Palm Street to South Boulevard, was previously conveyed to the County within the time prescribed. The second part, identified as Portion "B" in the Agreement, from US Highway 17/92 to Palm Street, along with the drainage easements for associated storm water management facilities, is to be conveyed/granted to the County prior to July 8, 2024 based on a subsequent extension amendment to the Agreement. The Developer, along with the North Powerline Road Community Development District ("CDD") as a successor in title to one of the right-of-way parcels, have executed and delivered Warranty Deeds for the Portion "B" right-of-way less a small segment located at the connection of Power Line Road and US Highway 17/92. The Developer is awaiting a permit from, and working with, FDOT for the connection to the state road which may affect the right-of-way needed at this location. The Developer, along with the CDD have also executed and delivered, Perpetual Joint Use Drainage Easements for the five ponds needed to accommodate storm water management for the roadway.
