DESCRIPTION
Request the Board, by its own motion, adopt a resolution vacating a portion of Delbert Collins Road, a county maintained road located in Lake Alfred, as shown on the Maintained Right-of-Way Map recorded in Map Book 11, Pages 193 through 198, Public Records of Polk County, Florida, to accommodate a proposed development.
Through the development process a proposed development was submitted which proposed the realignment of a portion of a County maintained public road known as Delbert Collins Road lying adjacent to the development. Through discussions with the landowner in conjunction with the development of its property, through the platting process with the City of Lake Alfred, it was agreed that the best way to bring the substandard road up to current road classification standards would be to vacate the portion of the existing maintained right-of-way lying adjacent to the proposed development, within Section 26, in its entirety and the landowner would convey to the County, by deed, the full right-of-way needed for the realigned and upgraded roadway prior to completing the platting process through the City. It was requested by the landowner/developer that the County approve and execute a County Deed to release any interest it that may remain in that part of the vacated right-of-way that lies outside of the limits of the new right-of-way, for title clearing purposes.
