DESCRIPTION
The County received a petition from Frank Appunn to vacate a portion of the platted drainage/retention easement lying within Lot 30, as shown on the plat of Country Class Estates Phase Two, recorded in Plat Book 92, Pages 45 and 46, Public Records of Polk County, Florida. The subject easement is located in Section 07, Township 28 South, Range 23 East.
The plat of Country Class Estates Phase Two filed in 1991, dedicated all of the rights-of-way and easements shown thereon to the use of the public. The petitioner is the owner of Lot 30 which contains a single-family residence and is encumbered by a large platted drainage easement over the rear of the property. The petitioner purchased the property approximately two years ago and a recent survey revealed that an addition to the residence, along with two sheds, associated with the prior owner encroach into the drainage easement. The petitioner is requesting the vacation of a portion of the platted drainage easement in order to clear the encroachments caused by the home addition and sheds created by the previous owner and to allow for future improvements and/or pool to the rear of the current residence. The County's Roads and Drainage Division staff and the County Engineer have reviewed the request and have no objections to vacating the subject portion of the easement. Vacating the requested portion of the platted drainage/retention easement will remove the public's interest in the subject area and will allow the petitioner to resolve the existing encroachments and move forward with any future improvement plans.
