DESCRIPTION

A proposed large-scale residential development located along both sides of Lake Lowery Road to the north of Old Haines City/Lake Alfred Road is being developed in phases with multiple connections to Lake Lowery Road.  The County, through its Development Review Process, is requesting improvements to Lake Lowery Road adjacent to all of the phases due to the impacts caused by the proposed development which consist primarily of roadway widening and includes a roundabout at the northern end of the development.  The developer, BF-KL Lowery Hills LLC (“BF-KL”) is constructing the improvements to Lake Lowery Road and has already conveyed additional right-of-way to the County for the majority of the roadway improvements.  However, a small right-of-way parcel is needed from an adjacent property owner near the northern end of the development.  BF-KL has coordinated with the owner of the property, Edward A. Arbuthnot, Successor Trustee, who has executed a delivered a Quit Claim Deed to the County for the additional right-of-way parcel.  Accepting the Quit Claim Deed from Edward A. Arbuthnot, as Successor Trustee will give the County the right-of-way needed for Lake Lowery Road in conjunction with the development and improvements.

RECOMMENDATION

Request Board accept the afore-mentioned Quit Claim Deed.
