DESCRIPTION
The plat of Waverly, filed in 1912 in Plat Book 3, at Page 7, depicts a parcel identified as "Park" which is presumed to be dedicated to the public due to a lack of dedication to the contrary. The Park parcel, identified as Parcel ID Number 272910-859000-047000, is a vacant triangular-shaped parcel containing approximately 1.23-acres located along the southerly side of Waverly Road near its intersection with C.F. Kinney Road in the Waverly area north of Lake Wales. The subject parcel includes portions of platted right-of-way along the western and southern boundaries which were previously vacated and assembled with the parcel. Large tracts of land adjacent to the Park parcel are owned by Tampa Electric Company ("TECO") which were acquired for its solar farm. TECO contacted the County and requested to purchase the Park parcel for use in its solar farm. The County hired an independent appraiser to establish a value for the property and subsequent negotiations with TECO have resulted in a proposed purchase price of $50,000. TECO has approved and executed a Purchase and Sale Agreement for the purchase of the Park parcel. The County Attorney's Office and the Real Estate Services Director have reviewed the agreement and recommend approval.
Florida Statutes allow for the conveyance by the County of lands dedicated for park purposes and allow for the disposal of property by declaring the property surplus and authorizing its private conveyance.
