Request the Board authorize the filing of a temporary and permanent prohibitory injunction complaint against 1027 Fantasy, LLC for violating the Florida Building Code by allowing people to occupy a structure without a County issued Certificate of Occupancy.

DESCRIPTION
Mr. Emanual Mohammed is the manager of the structure located at 1027 Fantasy Drive, Davenport, FL 33896. On October 10, 2023, the County sent Mr. Mohammed a certified letter informing him that the structure must be vacated and remain vacant until a Certificate of Occupancy was issued. On April 10, 2024, the County learned that the structure was not vacant and was in fact being occupied by a family. As of April 10, 2024, a Certificate of Occupancy has not been issued for the structure.
RECOMMENDATION
Authorize the County Attorney’s Office to file a temporary and prohibitory injunction complaint and take other necessary legal actions against 1027 Fantasy, LLC and other necessary parties for violating the Florida Building Code and other codes, regulations, laws of Polk County and/or the state.
FISCAL IMPACT
Funding for the costs of litigation will come from the County Attorney’s Fund.
