DESCRIPTION
This is a County-initiated request amending Chapter 5, Chapter 6, Chapter 7, Chapter 8, and Chapter 10, to add the Nutrient Restoration Plan Overlay, restrictions on septic tanks, and definitions; providing for severability; and providing for an effective date. This case is related to LDCPAL-2023-13. State law requires one Planning Commission hearing, which was held on March 6, to add the Nutrient Restoration Plan Overlay, restrictions on septic tanks, and definitions; providing for severability. The Planning Commission voted 5-1 to recommend approval.
Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan. Amendments to the LDC require two public hearings before the Board to be adopted. This is the second of the two hearings. The adoption hearing was for June 18, 2024 however, was continued to July 16, 2024. Another continuance is needed to address comments received by the Florida Department of Environmental Protection (FDEP).
