Approve Modification No. 3 to CSA No. 22-88-02 between Polk County and HNTB Corporation for post-design services of the Cooley Road Sidewalk project. ($27,059.00 one-time expense)

DESCRIPTION
The original design contract with HNTB was for the design of a new sidewalk along Cooley Road from Normandy Heights Drive to Recker Highway in Winter Haven. This agreement was executed on 1/9/24 in the amount of $156,998. Subsequently, Modification 1 was executed on 10/23/24 for $45,415 because the fee for drainage services negotiated was not included in the original contract amount. This brought the contract limit up to $202,413. No contract time was added as part of Modification 1.
During the Design Phase the County requested additional services be included within the project limits. Additional services include drainage and permitting associated with an existing cross drain that will be replaced; development of a full Maintenance of Traffic plan for vehicles and pedestrians due to the need for a full road closure during construction; coordination with FDOT regarding the interface with Recker Highway; and the updating of the proposed estimate of construction costs. Modification 2 is in the amount of $70,475, bringing the contract limit to $272,888. An additional 150 days was added to the contract duration. This modification also established a new date for submittal of FINAL plans on or before January 21, 2026.
Final signed and sealed plans have been submitted, and the FDOT Construction Agreement was approved by the BoCC on August 4th, 2026. Once the FDOT Construction Agreement is approved, the project will be able to be bid out to potential contractors. Due to there being several drainage structures and the location of the project and its proximity to a State Road, the County requested post-design services be provided by the consultant to assist the contractor with any issues that may arise during construction.
