Accept a Perpetual Joint Use Drainage Easement for drainage improvements along Holly Hill Cutoff Road. (No fiscal impact)

DESCRIPTION
Polk County has plans to improve drainage along a public roadway known as Holly Hill Cutoff Road to alleviate flooding concerns in the area. The proposed plans consist of the installation of inlets, pipelines and a mitered end section to divert storm water runoff from the roadway into an existing subdivision storm water retention pond. The existing storm water pond is located within a portion of a platted tract which is owned by The Estates of Lake St. Charles Home Owner’s Association (“HOA”). The County contacted representatives from the HOA regarding the proposed improvements and requested an easement over that portion of the platted tract containing the existing retention pond. The existing pond contains sufficient capacity for the improvements; however, the County has agreed to modify the existing permit as part of the project. The HOA has agreed to the County’s request and has executed and delivered a Perpetual Joint Use Drainage Easement which states that the HOA is responsible to continue to maintain and re-certify the pond as necessary. Accepting the Perpetual Joint Use Drainage Easement will allow the County to move forward with the planned drainage improvements.
RECOMMENDATION
Request Board accept the aforementioned Perpetual Joint Use Drainage Easement.
