Approve Amendment No. 1 for the Local Agency Program (LAP) Agreement #446294-1-58/68-01 between Polk County and the Florida Department of Transportation (FDOT) in conjunction with the Maine Avenue Sidewalk project. (No fiscal impact)

DESCRIPTION
On March 18, 2025, the Board approved the FDOT pass-through LAP funding, financial oversight on construction and CEI services, and resolution No. 2025-029 on the Maine Avenue Sidewalk from Combee Road to Reynolds Road (FPN 446294-1-/5868-01). The LAP Agreement includes $3,100,293.00 for construction and $128,149.00 for CEI services for a total of $3,228,442.00. The project consists of a 5-foot to 6-foot wide ADA compliant concrete sidewalk and crosswalks along the south side of Maine Avenue, limited areas of curb and gutter and retaining walls, and minor improvements to the existing drainage system. The overall project length is approximately 0.9 miles. The project design is complete.
On April 21, 2026, The Board approved the construction contract with Rogar Management & Consulting of FL, LLC in the amount of $2,418,618.50. On May 20, 2026, the Board approved the CEI Services with Johnson, Mirmiran, & Thompson, Inc. in the amount of $397,003.00.
The purpose of this supplemental agreement is to increase funds to provide additional funding to compensate for the project shortfall in CEI services funding due to inflation, resulting in an additional $268,854.00. The new CEI costs will be $397,003.00 and the total construction costs will remain the same at $3,100,293.00. The total Department participation will increase to $3,497,296.00
RECOMMENDATION
Request Board approval and execute the LAP Agreement - Amendment #1 between Polk County and the FDOT for the Maine Avenue Sidewalk project.
FISCAL IMPACT
No fiscal impact unless the project costs exceed the LAP Agreement amount and FDOT does not cover the additional costs.
