DESCRIPTION
This is an applicant-initiated request for an LDC text amendment to Chapter 4 Section 401.04 for the US 98 Selected Area Plan (SAP) to allow over 30% retail and personal services in Employment Center (ECX) when approved by a Level 3 Conditional Use. State law requires one Planning Commission hearing, which was held on November 5, 2025, with a recommendation for approval by a 6/1 vote.
Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan. Amendments to the LDC require two public hearings before the Board to be adopted.
RECOMMENDATION
Request Board set the first reading on December 2, 2025, at 9:15 a.m., and the adoption hearing on January 20, 2026, at 9:15 a.m.
