Approve Agreement for Transfer of Public Roads between the City of Haines City and Polk County for all of Thirtieth Street and authorize County Deed for the rights-of-way associated therewith. (No fiscal impact)

DESCRIPTION
Thirtieth Street is a county-maintained roadway running from CR 544 north to Baker Dairy Road. The road is classified as an urban collector roadway and lies within and/or adjacent to the municipal limits of the City of Haines City (“City”). It is proposed to be transferred to the City in conjunction with proposed development adjacent to the roadway.
Florida Statutes allow for the transfer of public roads between jurisdictions by mutual agreement of the affected governments and a conveyance of the associated rights-of-way by deed. The City has reviewed and approved, at its meeting held October 1, 2024, an Agreement for Transfer of Public Roads for the transfer of the roadway and has agreed to accept the County Deed for the associated right-of-way. Approving said Agreement and authorizing the County Deed to the City for the associated right-of-way will transfer ownership of the subject road and will remove the roadway from the County’s Road inventory thereby allowing the County to cease maintenance and future liability responsibilities associated with it.
RECOMMENDATION
Request Board approve the aforementioned Agreement for Transfer of Public Road and authorize the County Deed to the City for the right-of-way associated therewith.
