DESCRIPTION
The County has received a petition from Harold J. Myers, as authorized agent for Arizona Holding III, LLC and Arizona Holding IV, LLC, to vacate a portion of platted, unopened, and unmaintained right-of-way lying within the map of Cruse and Horney's First Addition to Lake Bonny Park recorded in Plat Book 8, Page 45, of the Public Records of Polk County, Florida. The subject right-of-way lies in Section 16, Township 28 South, Range 24 East.
The map of Cruse and Horney's First Addition to Lake Bonny Park, filed in 1925 depicts various rights-of-way throughout the map which are presumed to be public due to a lack of dedication to the contrary. A 40-foot wide unnamed, unopened and unmaintained right-of-way lies between Lot 5 of Block 3 and Lot 3 of Block 4, which are owned by the petitioners. The petitioners are requesting the vacation to remove the bifurcation caused by the right-of-way and to assemble with their adjacent property to accommodate for future development. Vacating the subject right-of-way will remove the public's interest in the subject area and allow the petitioners to assemble it with their adjacent properties and move forward with their development plans.
The City of Lakeland Electric, City of Lakeland Water and Wastewater, Frontier Communications, and Tillman Fiberco have no objections to the proposed vacation.
The Office of Planning and Development and Polk County Utilities have no objections to the proposed vacation.
