DESCRIPTION

The Southwest Florida Water Management District (SWFWMD) contacted the County and requested to use a small portion of strip of land owned by the County which lies westerly of Lake Lowery Road lying within Sections 11 and 14, Township 27 South, Range 26 East.  The strip appears to have been conveyed as right-of-way but the requested portion is not currently being utilized by the County for a roadway or any other purpose. SWFWMD has requested a Perpetual Easement for a 10-foot by 20-foot area to allow for the operation, maintenance, repair, or replacement of two monitoring wells and data monitoring equipment in conjunction with its Central Florida Water Initiative and Data, Monitoring and Investigations Team.  SWFWMD has also requested a Temporary License Agreement from the County for an area adjacent to the perpetual easement to allow for construction activities associated with the installation of the monitoring wells.  The license period begins upon the initial start of project construction by SWFWMD and will continue in effect through the completion of construction of the project, and allows for its termination by either party with sixty (60) days written notice.  Approving the Perpetual Easement and License Agreement will allow SWFWMD to utilize the property for its monitor well project.

RECOMMENDATION

Request Board accept and approve the aforementioned Perpetual Easement and License Agreement.
