DESCRIPTION

In July of 1984 Thomas E. Vann, III, granted to the County a Drainage Easement which was recorded in O.R. Book 2264, at Pages 1626 and 1627, Public Records of Polk County, Florida.  The County recently completed a drainage improvement project to alleviate flooding concerns in and around an unrecorded subdivision known as Rolling Oaks Estates.  The project included the installation of new drainage pipeline along the western boundary of a property owned by Lee H. Hart and Margie V. Hart, identified as Parcel ID Number 232717-000000-031310 to replace an existing drainage pipeline located to the east thereof on the Owners’ property and within the above-mentioned easement.  In October of 2024 the Owners entered into an Agreement with the County in which the Owners agreed to grant a new easement for the project and the County agreed to release that portion of the existing easement lying to the east thereof which is no longer needed.  The Owners subsequently granted a Drainage Easement to the County which was recorded in O.R. Book 13324 at Pages 896 through 899, Public Records of Polk County, Florida and the drainage project is now completed.  Approving the Partial Release of Easement will release the encumbrance of that portion of the existing drainage easement on the Owners’ property which is no longer needed.

RECOMMENDATION

Request Board approve the aforementioned Partial Release of Easement.
