DESCRIPTION

The County has received a petition from JSK Consulting, as authorized agent for ADM Florida Properties LLC, to vacate a portion of platted, unopened, and unmaintained right-of-way (alley) lying southwesterly of Lots 1, 4, 5 and 8, and lying northeasterly of Lots 2, 3, 6 and 7, all within Block 6, Tier 3, as shown on the map of Haskell, recorded in Plat Book 1, Page 5A, Public Records of Polk County, Florida.  The subject right-of-way lies in Section 14, Township 29 South, Range 24 East.

The map of Haskell, filed in 1886, depicts various rights-of-way, including alleys, throughout the plat. The petitioner owns all of the lots listed above which are bifurcated by the platted right-of-way (alley) and it has requested the vacation in order to accommodate its plans to develop the properties.  Vacating the right-of-way (alley) will remove the public’s interest in the subject area which will remove the bifurcation and allow the petitioner to more fully utilize its property for the planned development. 

 

Frontier Communications, City of Lakeland Electric, City of Lakeland Water/Wastewater, Zayo Group and Charter Communications have no objections to the proposed vacation.

 

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.

 

RECOMMENDATION

Request Board adopt a resolution to vacate platted, unopened, and unmaintained right-of-way (alley) as shown on the map of Haskell and as fully more fully described in the legal description attached to the Petition and Resolution attached hereto.

 

FISCAL IMPACT

No fiscal impact.
