DESCRIPTION

This is an applicant-initiated LDC Text Amendment text amendment to Appendix E adding conditions for development.  This request is related to a Small Scale Comprehensive Plan map amendment (LDCPAS-2026-9), for a property located west side of Lake Marion Creek Drive, north of Marigold Avenue, east of Lake Marion, south of Pine and east of Haines City, in Sections 9 & 10, Township 28, Range 28.

State law requires one Planning Commission hearing, which was held on September 2, 2026, with a recommendation for conditional approval (7:0). Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan.  Amendments to the LDC require two public hearings before the Board to be adopted. This is the first of the two hearings.
